Privacy Policy

Livan Agency, LLC  |  Effective Date: August 1, 2026

This Privacy Policy (“Policy”) describes how Livan Agency, LLC (“Company,” “we,” “us,” or “our”) collects, uses, shares, and protects personal information in connection with www.livanagency.com (the “Site”) and our insurance and employee benefits brokerage services. Because we help employer clients design, place, and administer employee benefit plans — including group health plans — this Policy also explains how we handle health information subject to the Health Insurance Portability and Accountability Act (“HIPAA”) and financial information subject to the Gramm-Leach-Bliley Act (“GLBA”).

By using the Site or engaging our brokerage services, you acknowledge the practices described in this Policy.

1. Information We Collect

We may collect the following categories of information:

  • Identifiers: first and last name, mailing address, email address, phone number, IP address

  • Employment-related information: employer name, job title, employee ID

  • Enrollment information: date of birth, gender, dependent and beneficiary information

  • Government identifiers: Social Security number or taxpayer ID, where required for enrollment, underwriting, or claims administration

  • Health information: coverage elections, evidence of insurability, and, in limited cases, information relevant to claims or underwriting

  • Financial information: billing and payment information, and other nonpublic personal financial information related to insurance products

  • Information from employer plan sponsors and carriers: census, eligibility, enrollment, or claims data received in the course of providing brokerage or consulting services

  • Automatically collected information: browser type, device information, pages visited, referring URLs, and approximate location, collected via cookies and similar technologies (see Section 8)

We collect this information directly from you, from employer plan sponsors, from insurance carriers and third-party administrators, and automatically through the Site. We do not collect personal information beyond what is necessary to provide our services unless you voluntarily provide additional information.

2. How We Use Your Information

  • Quote, place, service, and renew insurance and employee benefit coverage

  • Administer enrollment, eligibility, and claims on behalf of employer plan sponsors

  • Communicate with you about coverage, renewals, claims, and account matters

  • Comply with legal, regulatory, and insurance licensing obligations

  • Maintain and improve the Site and our services

  • With your consent, send marketing or promotional communications

3. How We Share Your Information

We do not sell, rent, or lease personal information to third parties for monetary consideration. We may share personal information as necessary to provide insurance and benefits brokerage services, including with:

  • Insurance carriers, underwriters, and managing general agents, for quoting, underwriting, placing, servicing, and renewing coverage

  • Claims administrators, adjusters, and other parties involved in handling or administering insurance claims

  • Service providers who perform functions on our behalf, such as website hosting, data storage, analytics, customer support, and payment processing

  • Government agencies, regulators, or law enforcement, when required by law, legal process, or regulatory obligation

  • Professional advisors, including attorneys, accountants, auditors, and compliance consultants, for legitimate business purposes

We require service providers and other authorized recipients to maintain appropriate safeguards and to use personal information only for the purposes for which it was disclosed. As described in Section 9, certain uses of cookies for analytics or advertising purposes may be considered a “sale” or “share” of personal information under some state privacy laws, even though no money changes hands.

4. Definition of “Third-Party Service Providers”

For purposes of this Policy, “third-party service providers” means vendors and contractors we engage to perform functions on our behalf, such as website hosting, data storage, information technology support, analytics, customer support, and payment processing. For example, we use Microsoft 365 for business email, document storage, and productivity services, and RingCentral for phone and text messaging communications. Third-party service providers may access personal information only as necessary to perform their designated functions, are contractually prohibited from using personal information for their own independent purposes, and are required to maintain safeguards to protect personal information consistent with this Policy and applicable law.

5. Protected Health Information (HIPAA)

When we assist employer clients with the placement and administration of group health plans, we may create, receive, maintain, or transmit Protected Health Information (“PHI”) as defined under HIPAA. In that capacity, we typically act as a Business Associate of the employer-sponsored health plan or of the applicable insurance carrier, under a written Business Associate Agreement, and we handle PHI only as permitted by that agreement and by HIPAA’s Privacy, Security, and Breach Notification Rules.

We do not use or disclose PHI for purposes other than those permitted under HIPAA and our applicable agreements. Questions about a specific health plan’s Notice of Privacy Practices should be directed to your employer (as plan sponsor) or the applicable insurance carrier, as we are not the administrator of the underlying health plan.

6. Nonpublic Personal Financial Information (GLBA)

As a licensed insurance producer, we are subject to the Gramm-Leach-Bliley Act and applicable Missouri insurance information privacy regulations governing nonpublic personal financial information (“NPI”). We collect NPI, such as Social Security numbers and financial account information, solely to provide insurance quoting, placement, underwriting support, and servicing.

We do not disclose NPI to nonaffiliated third parties except as permitted by law, including disclosures to carriers and service providers necessary to provide the products and services you have requested, or as required by regulators. You may opt out of disclosures of NPI for marketing purposes that are not necessary to service your policy by contacting us using the information in Section 22. We maintain administrative, technical, and physical safeguards designed to comply with applicable insurance data-security regulations.

7. Cookies and Tracking Technologies

The Site may use cookies and similar technologies to support core functionality, remember your preferences, and understand how visitors use the Site, including through analytics tools. Cookies are text files placed on your device by a web server; they cannot run programs or transmit viruses.

Most browsers accept cookies automatically, but you can usually change your browser settings to decline or delete cookies. If you decline cookies, some features of the Site may not function as intended. Where required by law, we will honor recognized opt-out signals, such as the Global Privacy Control, with respect to analytics or advertising cookies.

8. Automatically Collected Information

We may automatically collect information about your device and browsing activity, including your IP address, browser type, domain names, access times, and referring website addresses. We use this information to operate and secure the Site, maintain service quality, and compile general usage statistics.

9. Your Privacy Choices and Rights

Depending on your state of residence, you may have rights under applicable privacy laws — for example, the California Consumer Privacy Act (as amended by the CPRA), and comparable laws in states such as Colorado, Connecticut, Virginia, and Utah. Subject to applicable exceptions, these rights may include the right to:

  • Know what personal information we have collected, used, or disclosed about you

  • Request correction of inaccurate personal information

  • Request deletion of your personal information

  • Opt out of the sale or sharing of your personal information, and limit the use of sensitive personal information

  • Not receive discriminatory treatment for exercising these rights

We do not sell personal information for monetary consideration. To the extent our use of analytics or advertising cookies is considered a “share” under applicable law, you may opt out at livanagency@livanagency.com or by contacting us using the information in Section 22.

To submit a request to exercise any of these rights, contact us as described in Section 22. We will verify your identity before responding and will respond within the timeframe required by applicable law (generally 45 days, with a possible extension).

If you would like to stop receiving marketing or promotional emails from us, you may unsubscribe using the link included in those emails or by contacting us at the information in Section 22.

10. SMS/Text Messaging Communications

If you provide your mobile phone number and consent to receive text messages, we may send SMS/text messages related to your coverage, enrollment, renewals, appointment reminders, or account servicing, and, where you have separately opted in, promotional or marketing messages. We send these messages using RingCentral, our phone and text messaging service provider. Message and data rates may apply, and message frequency varies depending on your account activity and preferences. Consent to receive text messages is not a condition of purchasing any insurance product or service.

You may opt out of receiving SMS/text messages from us at any time by replying “STOP” to any text message you receive from us, or by contacting us using the information in Section

22. After you opt out, we will send one final message confirming your opt-out, and you will not receive further text messages from us unless you opt back in. For help, reply “HELP” to any message or contact us directly using the information in Section 22.

Opting out of SMS/text messages does not automatically opt you out of other forms of communication, such as email or phone calls; you may need to separately request that those communications stop. We do not sell or share your mobile phone number, or your SMS opt-in or opt-out status, with third parties for their own marketing purposes.

11. Sensitive Personal Information

Certain information we collect — including Social Security numbers and health-related information — is considered “sensitive personal information” under some state privacy laws. We collect and use this information only as reasonably necessary to provide insurance and employee benefits brokerage services, and we do not use it for purposes beyond those permitted by applicable law.

12. Data Retention

We retain personal information for as long as reasonably necessary to provide our services, comply with legal, regulatory, and insurance recordkeeping requirements, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and applicable legal requirements.

13. Location of Data Processing

Personal information may be stored and processed in the United States and other jurisdictions where our service providers operate. By using the Site or our services, you acknowledge that your personal information may be transferred to, and stored and processed in, a country other than your country of residence, which may have data protection laws that differ from those of your jurisdiction. We take reasonable steps to ensure personal information receives an adequate level of protection in the jurisdictions in which we and our service providers process it.

14. Data Security and Breach Notification

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, acquisition, disclosure, or use, including SSL encryption for information transmitted through the Site. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

In the event of a security incident involving personal information, we will investigate promptly and provide notice to affected individuals and, where required, to applicable regulators, in the manner and within the timeframes required by applicable law, including Missouri's breach notification statute.

15. Children’s Privacy

The Site is not directed to children, and we do not knowingly collect personal information from children under the age of 13. If you are under 13, please do not use the Site without the involvement of a parent or guardian.

16. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content or privacy practices of those sites, and we encourage you to review their privacy policies before providing personal information.

17. Accessibility Statement (ADA Compliance)

We are committed to ensuring the Site is accessible to individuals with disabilities. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, as a general accessibility standard. If you experience difficulty accessing any part of the Site, or if you require assistance with information in this Policy in an alternative format, please contact us using the information in Section 22, and we will make reasonable efforts to accommodate your request.

18. California Shine the Light Disclosure

California Civil Code Section 1798.83 (the “Shine the Light” law) permits California residents to request certain information regarding our disclosure, if any, of personal information to third parties for those third parties’ own direct marketing purposes during the preceding calendar year. As described in Section 3, we do not share personal information with third parties for their own independent direct marketing purposes without your consent. California residents may nonetheless submit a Shine the Light request once per calendar year, free of charge, using the contact information in Section 22.

19. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or applicable law. If we make material changes, we will notify you by posting a notice on the Site, updating the effective date, or, where appropriate, contacting you directly. Your continued use of the Site after changes take effect constitutes acceptance of the updated Policy.

20. Severability

If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Policy will continue in full force and effect.

21. Governing Law and Forum Selection

This Policy is governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Policy or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Jackson County, Missouri, and you consent to personal jurisdiction and venue in those courts.
